The Ninth Circuit released Harris yesterday, December 21, 2009. In Harris, the Ninth Circuit grappled with factually and procedurally difficult questions. One of those was whether a Bankruptcy Court lacked subject matter jurisdiction when it heard a state law breach of contract claim. A state law claim does not “arise under” Title 11, but the Ninth Circuit concluded it did “arise in” a bankruptcy case because the debtor, the trustee, and an assignee of the trustee formed the contract so the parties could resolve a fraudulent transfer raised in the case. The existence of the bankruptcy case is critical because the claim would not exist but for Title 11. Moreover, it was a “core” proceeding because the debtor alleged that the trustee breached her contract not to sell estate assets, an estate created by the Bankruptcy Code.

To-do list

I’m sitting in the airport at Sea-Tac writing this, sitting on the floor, juicing up the little Dell mini.

Law school is over.

Over, that is, if I manage to pass my classes. I’m probably not ready to write anything about my law school experience yet. All I can say now is that I’m mostly just sad that it’s over.

I write to share my to-do list with you. I only do so because most people I tell seem startled by it, and maybe you will be too. I think it’s exciting. Over the two to three months, I have to do the following:

  • Start a new job
  • Study for the bar exam
  • Have a child
  • Move out of state to Phoenix
  • Take the Arizona bar exam
  • Sell my condo or rent it out
  • Move from Phoenix to Tucson
  • Start another new job

So that’s it. The five year fog of law school (when I count the LSAT and the whole application process) is over. Five years feels like five minutes right now.
